Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms, including any future updates. If you do not agree with these Terms, you must discontinue use of the Platform immediately.

Services Provided

From Scratch / Norriva provides a SaaS platform designed to help you manage and optimize your go-to-market (GTM) strategy. The Platform includes various applications, tools, features, and resources to assist with marketing, sales, customer success, and more.

Subscription and Payment

3.1 Subscription Plans
You can subscribe to the Platform via different pricing plans. Details of these plans, including features and pricing, are available on our pricing section on our website. Subscriptions will be billed according to the plan you select.

3.2 Payment Terms
All fees for the Platform are due in advance as outlined during the subscription process. You agree to pay all applicable fees promptly.

3.3 Free Trials and Promotions
We may offer a free trial or promotional period. After the free trial or promotional period ends, you will be charged the applicable subscription fee unless you cancel the subscription before the trial period ends.

3.4 Payment Methods
You agree to provide accurate and complete billing information. We accept various payment methods as listed on the Platform.

3.5 Taxes
You are responsible for all taxes, duties, or fees applicable to your subscription.

User Responsibilities

4.1 Account Security
You are responsible for maintaining the security and confidentiality of your account login credentials. You agree to notify us immediately if you suspect any unauthorized use of your account.

4.2 Compliance
You agree to use the Platform in compliance with all applicable laws, regulations, and our Acceptable Use Policy (detailed below). You shall not use the Platform for illegal activities or in a manner that could damage, disable, or impair the Platform.

4.3 User Content
You retain ownership of any content you upload or input into the Platform ("User Content"). By using the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Content to provide the services.

Intellectual Property

5.1 Ownership
We own all rights, title, and interest in and to the Platform, including all intellectual property rights. This includes the design, functionality, and content of the Platform.

5.2 License
Upon subscription, we grant you a limited, non-transferable, non-exclusive license to access and use the Platform, subject to these Terms. This license is for your internal business use only and may not be shared with third parties.

Acceptable Use Policy

You agree not to:

• Use the Platform for illegal or unauthorized activities.
• Engage in any activity that could damage the reputation of From Scratch / Norriva or its services.
• Upload or transmit any harmful software, malware, or malicious code.
• Use the Platform in a way that disrupts or interferes with the performance of the Platform or other users.

Termination and Suspension

7.1 Termination by You
You can cancel your subscription at any time by following the cancellation instructions in your account settings. Cancellations will take effect at the end of your current billing cycle.

7.2 Termination by Us
We may suspend or terminate your access to the Platform if you violate these Terms or engage in unlawful activity. We will attempt to notify you prior to suspension or termination.

7.3 Effects of Termination
Upon termination, you will lose access to the Platform and any data stored within it. You are responsible for exporting any data before termination.

Data Privacy and Security

We take your privacy seriously. Our Privacy Policy outlines how we collect, use, and protect your personal and business data. By using the Platform, you agree to our Privacy Policy.

We do not warrant that use of the Service will be uninterrupted, secure, error-free, or free of harmful components, nor does it warrant any specific results. While we implement appropriate technical and organizational measures to safeguard data, it does not warrant absolute protection against all security threats or unauthorized access.

 

Limitations of Liability

To the fullest extent permitted by law, From Scratch / Norriva shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform. Our liability will be limited to the amount you have paid for the Platform in the last 12 months.

Dispute Resolution

10.1 Governing Law
These Terms are governed by the laws of Sweden, without regard to its conflict of law provisions.

10.2 Arbitration
Any disputes arising from these Terms or your use of the Platform will be resolved through binding arbitration, rather than in court.

Modifications to the Platform and Terms

We may make changes to, suspend, or discontinue certain features or aspects of the Platform as needed, with notice provided where applicable. We may also update these Terms from time to time. Any changes will be posted on our website, and the new terms will become effective immediately upon posting.

Miscellaneous

12.1 Entire Agreement
These Terms constitute the entire agreement between you and From Scratch / Norriva regarding your use of the Platform and supersede any prior agreements.

12.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

12.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision.
